OFFICIAL RULES

URCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THE CHALLENGE IS INTENDED FOR VIEWING IN ALABAMA, GEORGIA, FLORIDA, MISSISSIPPI, NORTH CAROLINA, SOUTH CAROLINA AND TENNESSEE ONLY AND WILL BE GOVERNED BY UNITED STATES LAW. VOID WHERE PROHIBITED.

 

1. ELIGIBLITY:

 

The “ULTRA – Putt Your Way to 10K” (“Challenge”) is open to legal residents of Alabama, Georgia, Florida, Mississippi, North Carolina, South Carolina and Tennessee who are twenty-one (21) years of age or older at the time of entry. Employees, contractors, directors, officers and agents of Anheuser-Busch, LLC, its affiliates and subsidiaries, advertising and promotion agencies, wholesale distributors, retail licensees, all other service agencies involved with the Challenge, and members of their immediate family (spouse, parent, child or sibling), are not eligible to enter or win. The Challenge is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions which are final and binding in all matters related to this Challenge. Winning a prize is contingent upon fulfilling all requirements as set forth herein.

 

2. IMPORTANT DATES AND TIME PERIODS:

 

Phase One: Local Wholesaler Putting Challenges: Begins on September 26, 2023 and ends on October 31, 2023. See Rule 3 for details.

 

Phase Two: Local Wholesaler Putting Finals: Begins on November 1, 2023 and ends on November 22, 2023. See Rule 4 for details.

 

Phase Three: The ULTRA Putting Championship: Begins and ends on a date and time in December 2023. See Rule 5 for details.

 

3. PHASE ONE: LOCAL WHOLESALER PUTTING CHALLENGES:

 

Local Wholesaler Putting Challenges (each a “Local Wholesaler Putting Challenge”) will take place between September 15, 2023 – October 31, 2023 at times to be determined by Sponsor, in Sponsor’s sole discretion. Look for the Local Wholesaler Putting Challenge at participating locations.

To play, sign up with the Michelob ULTRA Ambassador at the Local Wholesaler Putting Challenge location. All participants will be required to confirm eligibility and show proof of age using either a valid state Picture ID and/or Passport which properly shows participant’s date of birth. All participants will be required to sign a “Release of Liability, Voluntary Assumption of Risk and Indemnity Agreement” prior to participating in the Local Wholesaler Putting Challenge.

At each Local Wholesaler Putting Challenge, a portable artificial grass putting green mat will be set up on the floor with a hole (“Cup”) at one end. Participants for each head-to-head matchup (each a “Head-to-Head Matchup”) will be called to play in the order determined by the Michelob ULTRA Ambassador in his/her sole discretion. See Appendix A for “Participation Guidelines”. During each Head-to-Head Matchup, each participant will receive five (5) golf balls and have five (5) attempts to put as many golf balls as possible into the Cup. The one (1) participant who puts the most golf balls into the Cup will be deemed the winner of that Head-to-Head Matchup and advance to the next round of the Local Wholesaler Putting Challenge.

In the event of a tie, each participant of the Head-to-Head Matchup will receive three (3) golf balls and have three (3) attempts to put as many golf balls into the Cup as possible until the tie is broken.

The one (1) participant from the final Head-to-Head Matchup at the Local Wholesaler Putting Challenge will receive a prize as described below and will advance to the Local Wholesaler Putting Final (the “Local Wholesaler Putting Final”) on a day, time and at a location to be determined by Sponsor in Sponsor’s sole discretion.

Local Wholesaler Putting Challenge winners will be notified in advance of the date, time and location of the Local Wholesaler Putting Final. Participants may participate in a Local Wholesaler Putting Challenge at more than one (1) participating location, but after winning at one (1) participating Local Wholesaler Putting Challenge location, to advance to the Local Wholesaler Putting Final, may not advance to the Local Wholesaler Putting Final from another participating location.

Prize Details: Each Local Wholesaler Putting Challenge winner will receive one (1) item of Michelob UTLRA merchandise (exact item to be determined by Sponsor, in Sponsor’s sole discretion). Approximate Retail Value (“ARV”) is up to $50.00.

 

Limit one (1) prize per person. Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used.

 

If Sponsor so elects, winner may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be awarded to an alternate winner.

 

4. PHASE 2: LOCAL WHOLESLAER PUTTING FINALS:

 

Local Wholesaler Putting Finals (each a “Local Wholesaler Putting Final”) will take place between November 1, 2023 – November 22, 2023 at times to be determined by Sponsor, in Sponsor’s sole discretion.

At each Local Wholesaler Putting Final, a portable artificial grass putting green mat will be set up on the floor with a hole (also a “Cup”) at one end. Local Wholesaler Putting Final winners will be notified in advance of the date, time and location of the ULTRA Putting Championship. Participants may participate in a Local Wholesaler Putting Final at more than one (1) participating location, but after winning at one (1) participating Local Wholesaler Putting Final location, to advance to the ULTRA

Putting Championship, may not advance to the ULTRA Putting Championship from another participating location.

Prize Details: Each Local Wholesaler Final Challenge winner will receive the opportunity to participate in the ULTRA Putting Championship on a date and time and location to be determined by Sponsor, in Sponsor’s sole discretion. Prize includes hotel accommodations for two (2) consecutive nights, one (1) $300.00 pre-paid card that may be used for travel expenses and one (1) round of golf (18 holes of putting) at the ULTRA Putting Championship. The ULTRA Putting Championship is scheduled to occur in December 2023. Exact date, time and location of the ULTRA Putting Championship to be determined by Sponsor, in Sponsor’s sole discretion, and is subject to change. Air transportation, ground transportation, meals, gratuities, personal purchases and all other expenses not specified herein are solely winner’s responsibility. Winner will be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor on the date as directed by Sponsor. Winner’s one (1) guest must be twenty-one (21) years of age or older as of November 22, 2023 and will be required to complete, sign and return a “Release of Liability, Voluntary Assumption of Risk and Indemnity Agreement” to Sponsor on the date as directed by Sponsor. In the event of noncompliance, the prize may be forfeited and may be awarded to an alternate winner at Sponsor’s sole discretion. ARV is $860.00.

If Sponsor so elects, winner and one (1) guest may be required to submit to a confidential background check. If requested, the potential winner and one (1) guest agree to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be awarded to an alternate winner (time permitting).

 

5. PHASE 3: ULTRA PUTTING CHAMPIONSHIP:

 

The ULTRA Putting Championship will take place in December 2023 on a date, time and location to be determined by Sponsor, in Sponsor’s sole discretion, and subject to change.

At the ULTRA Putting Championship, there will be one (1) eighteen (18) hole putting course. Each participant will have the opportunity to put eighteen (18) holes on the putting course. The one (1) participant who has the lowest score will be deemed the Grand Prize winner and receive the Grand Prize. See Appendix A for “Participation Guidelines”.

In the event of a tie, the lowest scoring tied participants will complete against each other in a sudden death “hole-by-hole” playoff. The one (1) participant who has the lowest score during the sudden death “hole-by-hole” playoff will be deemed the Grand Prize winner and receive the Grand Prize.

Grand Prize Details: Winner will receive $10,000.00 [awarded in the form of a check made payable to winner; or, via pre-paid card(s)]. If winner cannot accept prize as specified, prize will be forfeited and may be awarded to an alternate winner in Sponsor’s sole discretion. ARV is $10,000.00. Any difference between stated value and actual value will not be awarded.

 

Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used.

6. GENERAL CONDITIONS:

 

Anheuser-Busch, LLC and each of their affiliates, subsidiaries and agencies (collectively the “Released Parties”) are responsible for lost, late, misdirected, unintelligible, returned or undelivered entries, telephone calls, text messages, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or

other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Challenge or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Website’s terms of service, as solely determined by the Sponsor, will be disqualified. Released Parties are not responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Challenge, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. Any use of robotic, macro, automatic, programmed or like Entry methods will void all such entries, and may subject that entrant to disqualification. Released Parties are not responsible for injury or damage to winners or any other person’s computer, or property related to or resulting from participating in this Challenge. Should any portion of Challenge be, in the Sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Challenge, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Challenge, and randomly select the winner from among all valid Entries received prior to action taken, or otherwise as may be deemed fair and equitable by the Sponsor. In the event of a dispute regarding Entries received from multiple users having the same email account, the authorized subscriber of the email account used to enter will be deemed to be the entrant and must comply with these Official Rules. The authorized account subscriber is the natural person who is assigned the email account by the organization responsible for assigning the email account. All materials submitted become the property of Anheuser-Busch, LLC and will not be returned.

 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF SPONSOR NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT.

 

7. PUBLICITY:

 

Acceptance of prize offered constitutes permission for Sponsor to use winner’s name, voice, biographical information and/or likeness for purposes of advertising and promotion without further compensation in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval as permitted by law.

 

8. RELEASE:

 

By accepting a prize, winner agrees to release and hold Anheuser-Busch, LLC harmless from all losses, damages, rights, claims and actions of any kind resulting from

acceptance, possession or use of any prize, including without limitation, personal injuries, death and property damage.

 

9. DISPUTE RESOLUTION:

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Challenge, or any claim or dispute that has arisen or may arise between you and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules. The place of arbitration shall be St. Louis, Missouri

APPENDIX A

 

PARTICIPATION GUIDELINES

 

· Each participant must attempt the golf putt on their own behalf. No one may attempt the golf putt on behalf of another participant.

 

· Participants may not attempt any practice or warm-up golf putts.

 

· All golf putts must occur in the presence of the Michelob ULTRA Ambassador. Any golf putt attempt not in the presence of the Michelob ULTRA Ambassador will be disqualified and is not eligible for the prize.

 

· No aid of any kind may be given to any participant in this Challenge. Nothing may be done to the golf ball or golf club that would enhance the participant’s chances of successfully completing the golf putt.

 

· The decisions of the Michelob ULTRA Ambassador as to the administration and operation of this Challenge is final and binding in all matters related to the Challenge.

 

· At no time while participating in the Challenge should any participant: (a) be under the influence of drugs or excess alcohol; (b) promote drinking and driving or the excessive or irresponsible consumption of alcohol; (c) promote the illegal use of alcohol, drugs, or violating any law; (d) communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; (e) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, or exploit people in a sexual or violent manner; (f) be obscene or offensive, endorse any form of hate or hate group; (g) otherwise fail to comply with the Beer Institute Advertising and Marketing Code as made publicly available at the following online location: http://www.beerinstitute.org/responsibility/advertising-marketing-code or (h) be deemed inappropriate or unsportsmanlike by the Michelob ULTRA Ambassador, in Michelob ULTRA Ambassador’s sole and absolute discretion. At any time during the Promotion, the Michelob ULTRA Ambassador reserves the right to disqualify any participant, in his/her sole discretion, if he/she believes that participant is not adhering to these Official Rules. Decisions of the Anheuser-Busch Ambassador are final in all matters relating to this Promotion.
